Liability Limits in Florida

Physicians in Florida typically carry limits of liability $250,000 per occurrence and $750,000 aggregate per policy period (1 year). Florida hospitals may require doctors to purchase a higher limit of liability to gain the right to obtain admitting privileges or to provide contract work for a hospital. Your broker can provide valuable support and insight on the matter of appropriate limits.  Unlike most other states Physicians in Florida are not required to carry medical malpractice insurance. However, there are strict procedures that must be followed if a physician opts not to purchase coverage including posting a bond to cover any potential claim.

Guaranty Fund Protection

Physicians insured by carriers licensed in the state of Florida are protected against carriers becoming insolvent by the Florida Insurance Guaranty Associating which is designed as a safety net should an admitted carrier become insolvent.  Coverage can be available for up to $300,000 or the policy limit if lower and is subject to a deductible. Non admitted carriers and RRGs are not protected by the Guaranty Association.
