When Searching for Medical Malpractice Insurance, Keep in Mind:

Liability Limits in Georgia

Most providers in Georgia are required to carry a minimum level medical malpractice insurance of $1,000,000 per occurrence and $3,000,000 in aggregate per year/policy period.  Due to this, malpractice insurers are required to provide insurance to all healthcare providers and not exclude any specialty or practice.  Limits of $1,000,000 per occurrence and $3,000,000 in aggregate are more common though.  Georgia hospitals may require doctors to purchase a higher limit of liability to gain the right to obtain admitting privileges or to provide contract work for a hospital. Your broker can provide valuable support and insight on the matter of appropriate limits.

Medical Malpractice Rates in Georgia

In the last few years, medical malpractice insurers have been raising rates in Georgia between 5-15% a year. Rates vary by practice specialty and what features physicians choose to include in their coverage, or whom they choose as a carrier. The knowledge of a broker experienced in placing medical malpractice insurance in Georgia ensures you obtain the best pricing and policy structure for your given specialty and territory.

Types of Carriers in Georgia

In Georgia, there are two distinct types of insurance providers offering medical malpractice insurance; admitted carriers and non-admitted carriers. The main difference between the two is in how each is licensed and regulated in Georgia.  There are certain considerations in determining which path is most appropriate and your broker should be able to guide you through the process.  There are a broad range of all carriers writing coverage in Georgia and our access to virtually all of the markets writing in Georgia ensures you obtain a competitive program.

Types of Coverage

As is the case in many other states, medical malpractice insurance in Georgia falls into three broad categories: claims-made coverage, occurrence coverage and tail coverage. Some carriers also offer a product referred to as a Modified Claims Made Policy, which combines aspects of occurrence and claims-made policies. These policies often come with tail coverage automatically included.  We can help you navigate and understand these types of policies.

Statute of Limitations

The statute of limitations in Georgia is two years from injury or death; in no event longer than five years from act or death. Foreign object: One year from discovery. Minors: Two years from 5th birthday if action arose before the child attained age of 5. Ga. Code §9-3-70 et seq.

Georgia Patient Compensation Fund

The state of Georgia does not have a Patient Compensation Fund.
